Nissan Company v. Maddox – Legal Reform

Kentucky Supreme Court

The state court will decide the types of liability that are appropriate when the allegedly defective product (here a seat belt) is compliant with government standards. In this case, a woman injured in a car accident with a drunk driver sued the manufacturer of her vehicle for design and warning defects related to the car’s seatbelt.  She alleged that the seat belt was designed for people of average weight, not of her plus size. The seatbelt complied with relevant federal motor vehicle safety standards and received high safety ratings.
