After Temporary Win On Overtime Rule, Small Businesses Plotting Path Forward

As they await a judicial decision that will hopefully make NFIB's hard-won victory permanent, businesses are taking different tacks to deal with the rule.

 

With a temporary win in hand on the overtime rule, small businesses now are plotting how they’ll move forward as they await a judicial decision that will hopefully make the victory permanent. 

A federal judge halted the new overtime rule set to go into effect Dec. 1, but some companies are still following through, according to The Wall Street Journal.

The rule would’ve made millions of American workers earning less than $47,476 a year newly eligible for overtime pay. Some businesses are going to make salary and employee adjustments in order to comply with the rule, even though it is currently not being enforced.

One company, San Diego-based Brand Value Accelerator, plans to give 13 of its 59 employees a wage increase or a shift to hourly compensation.

“If my business is running properly and profitably, the amount I have to pay on overtime will not be substantial,” said Dylan Whitman, CEO of Brand Value Accelerator.

Some small business owners say the “not knowing” is harder than the actual rules themselves, while others are playing the waiting game.

“We will just wait until we finally figure out what [the government] will actually do,” said Matt Agosta, CEO of Denver, N.C.-based Steele Rubber Products. “There is no sense in upsetting the cart at the moment.”
