Supreme
Court Ensures Small Business Has Access to Mobile Services

 

WASHINGTON, D.C., January
14, 2015 —
Karen Harned, Executive Director of NFIB’s Small Business Legal Center, made the following statement in response
to the Supreme Court’s ruling in T-Mobile
v. City of Roswell
, in which NFIB filed an amicus brief.

“NFIB thanks the Supreme Court for upholding the Telecommunications Act of
1996 and requiring local zoning authorities to provide an explanation of why
wirelesses infrastructure development is denied. When wireless projects that
small businesses depend on are unnecessarily slowed down or stopped –
businesses cannot operate effectively. By requiring zoning authorities to
justify decisions, they are also subject to judicial oversight. This allows for
a more fair and reasonable process in expanding critical infrastructure to
communities across the country.”

In this case, the Supreme Court ruled that local municipalities must
provide detailed explanations to wireless carriers when they deny applications
to build new cell towers. Many small businesses depend on the continued improvement
and deployment of wireless towers and mobile phone service to operate
effectively.
