Small Business Makes Ambush Rule a Top

Disapprove of NLRB union election rule forcing business owners to scramble
Washington, DC (March 3, 2015) – The National
Federation of Independent Business (NFIB) today urged every member of the
US Senate to back a resolution disapproving of a new labor rule that would
condense the time for union elections from more than a month to as few as 10
days, giving local business owners almost no time to talk to their workers and
make the necessary legal preparations.
The so-called Ambush Election Rule, approved last week by
the National Labor Relations Board (NLRB), allows unions to take as much time
as they need to secretly plan an election to organize a workplace but it gives
the business owner less than two weeks to prepare. Until now owners have
had weeks to talk to their workers, address their concerns, answer questions
and educate them on the potential effects.
“That tilts the game strongly in favor of the union because
the owner has very little time to educate his workers and secure legal counsel
to help navigate the process,” said NFIB Sr. Legal Counsel Beth Milito.
“The union can plan for weeks, even months, in advance and the owner has to scramble
to catch up.”
NFIB today sent a letter to every member of the Senate
urging them to pass a resolution, most likely today or tomorrow, disapproving
the rule under the Congressional Review Act. If the Senate passes the
measure it would move on to the House where it would also likely pass.
President Obama would then have to make a decision.
“The President would likely veto the measure, but he’ll have
to explain publicly and on the record why unions deserve another big advantage
over small business owners,” said Milito.
