The bill would have prohibited employers from taking action if an employee is
using paid sick time inappropriately. For example, if an employer notices that
an employee is consistently sick on Fridays, the employer, under this
provision, could be unable to change the employee’s work schedule, reduce their
hours or take another appropriate disciplinary action. It could even prevent
employers from having a conversation with employees about their abuse of sick
leave for fear that a later, unrelated disciplinary action would be construed
as connected to the earlier conversation.
