Protecting Property Rights and Avoiding Legal Costs

NFIB was successful in pursuing legislation to strengthen
property rights and avoid costly legal battles when a property owner has to
deal with persons trespassing on their property. House Bill 5335, signed into
law by Governor Snyder this year as Public Act 226, halts recent attempts by
the trial bar to loosen long standing case law in the area of trespasser
liability.

Without this new law, efforts by trial attorneys would
increase liability and exposure for private property owners. Small business is
especially vulnerable to this type of litigation. The law makes it clear that
current common law standards of duty and care with regard to trespassers are
kept in place.
