NFIB Stands Up Against Illegal Tax

Dan Murray, state director of the National Federation of Independent Business, released the following statement in response to NFIB’s amicus brief filing with in the case Heartland v. City of Mission. In this case the Supreme Court of Kansas will have to decide whether or not the City of Mission has the authority to enact a “transportation utility fee.”

“This case raises an important issue for small business in Kansas. At issue is a monetary exaction imposed on owners of developed property. The City of Mission takes money from the owners of developed properties for the purpose of maintaining and improving public roads, however owners are charged a different rate depending upon whether their development is categorized as “Single-family”; “Multi-family”; or “Non-residential.” This imposes financial burdens on small business owners wishing to make economically beneficial uses of their property. We urge the Kansas’s Supreme Court to overthrow the District Court’s decision and protect small businesses.
