NFIB Legal Center to Testify Against Ambush Rule

NFIB will testify before the Committee on Health,
Education, Labor, and Pensions

WASHINGTON, D.C., February 11, 2015 –
Beth Milito, Senior Executive Counsel of NFIB’s Small Business Legal Center,
will provide testimony this morning
on how the National Labor Relation Board’s new election rules will harm small
businesses. NFIB had sued and stopped the 2011 rule, and testified before the
NLRB in opposition to the reissuance in 2014. 

 “The NLRB is
intent on attacking the country’s most important employers – Main Street
businesses,” said NFIB’s Beth Milito. “The new election rules would make it
nearly impossible for employees to be fully informed about the issues they will
be voting on. It will also weaken the employer’s ability to communicate their
position during the election process.”

Under the new
rules, union representation elections could be held in as few as 14-20 days
after the filing of a union petition.  In 2011, the federal court deemed
the NLRB’s election rule invalid.     

“Union elections
are already held within 30 days of a petition being filed – leaving time for
both unions and employers to make their case, while employees have the
opportunity to make an informed decision. It is clear this NLRB policy change
favors helping union organizers win more certification elections,” said Milito.
