Nestle Dryer v. NLRB

On December 28, 2011, the National Labor Relations Board (NLRB) upheld a regional director's unit determination of maintenance employees at Nestle Dreyer's Ice Cream plant.  Thereafter, on May 18, the NLRB issued a decision finding that the company committed an unfair labor practice in refusing to bargain with the newly formed union. Nestle Dryer has appealed both decisions to the U.S. Court of Appeals for the Fourth Circuit, and NFIB Legal Center has filed in support of the appeal.

Status: Pending - U.S. Court of Appeals for the Fourth Circuit.
