Klairmont v. Gainsboro Restaurant

NFIB Legal Center joined a coalition of interested groups in filing an amicus brief on behalf of a small business in Massachusetts. The business had been sued under a state consumer protection statute, after a customer fell on the premises. We argued that litigants should not be able to advance claims against businesses under consumer protection statutes seeking compensation for personal injuries, which are more appropriately advanced as common law tort claims.

Status: Pending - Supreme Judicial Court of for the Commonwealth of Massachusetts.
