Howard v. A.W. Chesterton, Inc.

This case involves a key issue in asbestos litigation today: the "any exposure" theory of causation.  The Pennsylvania Superior Court authored one of the more thoughtful opinions explaining why this theory rests on "junk science."  But, now the Pennsylvania lowers courts are now trying to undermine this decision.

The NFIB Legal Center filed in this case to reaffirm the importance limiting employer liability in asbestos lawsuits.

Status: Pending - Pennsylvania Supreme Court.
