EEOC v. Peoplemark

The NFIB Legal Center is concerned with over-zealous enforcement actions against employers. Accordingly, we filed an amicus brief in this case to urge the Sixth Circuit federal court of appeals to hold that it is appropriate to dismiss a Title VII action brought by the Equal Employment Opportunity Commission (EEOC) when the agency failed to conduct any investigation or to engage in meaningful conciliation prior to filing suit. The court will also consider whether the EEOC should be ordered to pay the defendant’s attorney’s fees under such circumstances.
