Dram Shop Legislation

Rep. Barbieri and others have introduced HB 70 that would allow a person injured by an intoxicated minor to bring a civil cause of action against adults that provided the alcohol to the minor. The bill could open the door for lawsuits to be brought against hundreds of Delaware’s alcohol retailers and restaurant owners and their employees who may have unintentionally provided or sold alcohol to a minor. The legislation is currently pending in the House Judiciary Committee.
NFIB has issued an action alert and is urging all members to contact their elected officials to defeat this legislation.
