Mississippi Supreme Court
The Mississippi Supreme Court is considering a constitutional challenge to the state's $1 million general cap on noneconomic damages. The judge in the case lowered the non-economic damages to $1 million, which is the cap passed by the Mississippi Legislature in 2004.
Lymas' attorneys are challenging the constitutionality of the limit.
Status: DECIDED. Amicus brief filed in support of property owner on 12/14/09. Argument set for 6/8/10. Court reversed and rendered 9-0 on Lymas’ failure to prove proximate cause and dismissed the statutory cap issue as moot.
