Gained a Temporary Extension on Provisions of the Diesel Emission Reduction Act (DERA) of 2006

This initial legislation required all on-road and off-road heavy duty diesel vehicles which are owned or under contract with New York State to use ultra low sulfur diesel (ULSD) fuel and be fitted with the best available retrofit technologies by December 31, 2010. However, NFIB successfully lobbied during the 2011-12 state budget negotiations to makes some changes to this costly mandate. The enacted budget extends the time period of compliance for retrofitting heavy-duty diesel vehicles owned by State agencies or public authorities, as well as contractors, subcontractors and material suppliers who work on public job sites, with best available retrofit technology from December 31, 2010 to December 31, 2012.
While providing some significant temporary savings, this victory will give NFIB more time to lobby against this costly mandate and aim for total repeal.
