Cortez v. NACCO

In this case, the Oregon Court of Appeals ruled that workers’ compensation is not the “exclusive remedy” for injured workers. The ruling significantly undercuts liability protections from LLC owners and members. Accordingly NACCO is petitioning the Oregon Supreme Court for review of the case. Given the state-wide importance of this issue, the NFIB Legal Center filed an amicus brief in support of this petition on August 3, 2012. Now that the petition for review has been granted, NFIB Legal Center has filed an amicus brief on the merits.

Status:  Pending - Oregon Supreme Court.
